COUPLES

Introduction

At House of Fraser, we know how important your wedding day is and we want you to be delighted with our Wedding List Service (’Service’). These terms and conditions make it clear how the service works.

Once you have created your perfect Wedding List, we will make your Wedding List available to your Guests in order that they can purchase Gifts for delivery by us to you on a day of your choosing.

You agree, by using the Service, to be bound by these terms and conditions.

Definitions

"Account" means a sum of money held by us on your behalf until closure of your Wedding List. Your Account will hold any monies due to you where you have decided to select alternative Gifts or the Gifts are no longer available, until such time they are exchanged for alternative Gifts, converted into a House of Fraser Gift Card or returned to a Guest;
"Concierge" means a House of Fraser staff member who manages your Wedding List;
"Gift" means one or more of the products you can select for your Guests to purchase;
"Guest" means one or more of the products you can select for your Guests to purchase;
"List Holders" means you, the couple creating a Wedding List;
"Store" means a House of Fraser store, containing a designated Wedding List department, in which you create your Wedding List;
"Wedding List" means the list created by you from which Guests can purchase Gifts;
"Wedding List Website" means houseoffraserweddinglist.co.uk in which you can create your Wedding List;
"we/our/us" means House of Fraser (Stores) Limited, Granite House, 31 Stockwell Street, Glasgow G1 4RZ; and
"You/Your" means the List Holders.

Setting up a wedding list

You can create a Wedding List up to 12 weeks prior to your wedding date. The Wedding List is made available to your Guests 6 weeks prior to the wedding and ceases to be available for Guest purchases 2 days after your wedding.

Gifts

All Gifts listed on the Wedding List Website are available for inclusion on your Wedding List, even where they are not available in your chosen Store.

Product ranges vary from store to store, and not all products that are in store will be available for inclusion on your list. Where you wish to view a particular Gift in store, we recommend that you telephone your Concierge to check availability of the Gift before making a visit so as to avoid disappointment.

Availability of Gifts

We will endeavour to ensure that any Gift added to your Wedding List is available for delivery when a Guest purchases it. From time to time, it is possible that Gifts become unavailable and, if that is the case, your Concierge will advise you on possible alternatives to ensure that any disruption is kept to a minimum. Where this does occur you can choose either an alternative Gift in your Store or on the Wedding List Website or choose to have a House of Fraser Gift Card to the equivalent value. The monies paid by the Guest will be held on your Account whilst you decide. We will not inform your Guest that a substitution has occurred.

Because electrical products are often updated, we reserve the right to substitute the most up-to-date model after discussion with you.

Please note that House of Fraser Gift Cards have their own terms and conditions and cannot be used for the purchase of large kitchen appliances.

Age restricted Gifts

Your Wedding List may contain Gifts that are restricted in sale by law. The following laws apply to those Guests attempting to buy such Gifts:

  • Alcohol (or Gifts containing Alcohol) — it is illegal to sell alcohol to anyone under the age of 18.
  • Knives (or Gifts containing Knives) — it is illegal to sell a knife or blade to anyone under the age of 18.
  • Chocolate Liquors (or Gifts containing Chocolate Liquors) — it is illegal to sell chocolate liquors to anyone under the age of 16.

Your Guests undertake that both they (as purchaser) and you (as recipient) are of legal age when purchasing such Gifts.

Pricing policy

We take all reasonable care to ensure that the details, descriptions and prices of Gifts appearing on the Wedding List Website are correct at all times. However, Gifts on Wedding Lists are subject to price fluctuations in line with our in store prices on a day-to-day basis. As a result, prices may change between the time you create your Wedding List and during the purchasing period. Your Guests will be charged the price available on the Wedding List on the day the purchase is made. In the event that you decide to return a Gift purchased by a Guest, the amount paid will be credited to your Account, subject to our Alterations to Gifts and returns policy below.

Gift messages

Your Guests may leave a personal message for you when purchasing a Gift from your Wedding List. We do not take any responsibility for the contents of messages communicated by your Guests.

Delivery

Gifts will be delivered to your registered mainland UK (England, Wales, Scotland and Northern Ireland) or Eire address. To allow for the timely delivery of the Wedding List to you, we will collate the Gifts in our central warehouse as and when they are purchased by Guests. The delivery date will be agreed between you and your Concierge. The majority of Gifts will be available for delivery from 4 weeks after the wedding if you do not order any more Gifts when the Wedding List is closed. If you have asked that your Guests make pledges to a House of Fraser Gift Card, your Concierge will arrange to give it to you personally or send it to you.

All Gifts are wrapped carefully for delivery, but not gift wrapped. In the event of any damages, please contact your Concierge within 28 days of delivery.

Direct delivery products

Red Letter Days and Malmaison & Hotel du Vin vouchers will be delivered directly from the supplier, separate to your main delivery from us. These vouchers are non-refundable/exchangeable once received. You should read the supplier’s terms and conditions upon delivery, to ensure that you obtain full usage of the Gift.

Charges

The Wedding List Service includes one free delivery and there is no other charge to either you or your Guests for using our Service.

Alterations to Wedding List Gifts and our returns policy

We hope that you will be delighted with your Gifts, however if you are unhappy with any Gift that has been purchased by a Guest, you should contact your Concierge to arrange an exchange of up to a maximum of 25% of the total Gifts in line with our Refunds & Returns Policy within 28 days from the delivery date. The amount paid for the Gift will be credited to your Account to enable you to choose an alternative Gift or a House of Fraser Gift Card to the equivalent value. Please contact your Concierge as soon as possible if you wish to make any alterations. Our Refunds & Returns Policy can be found in any or our stores or online at www.houseoffraser.co.uk.

This policy does not affect your statutory rights in respect of faulty, damaged or incorrect goods.

Cancellation

If you wish to cancel your Wedding List for whatever reason, please let your Concierge know as soon as possible. Cancellations must be made in writing by both List Holders. As our contract is with the Guest, the effect of cancellation will mean that the Guest will receive a refund to their original method of payment.

Guest cancellations rights

Under the Consumer Contracts Regulations 2014, Guests can cancel their contract for the purchase of their Gifts any time up until the Gifts are delivered to you or within fourteen days of delivery to you for a full refund. Guests will need to call the Wedding List or visit a wedding list department in one of our stores to indicate that they wish to cancel their contract.

If a Guest exercises their right to cancel after their Gift has been despatched, you must return the Gift to us and must have taken reasonable care of the Gift whilst in your possession or during its return. Once we receive the Gift, we will refund the Guest to their original method of payment less any sums due by the way of compensation to either repair the goods or to cover any loss. It is the Guest's sole responsibility to arrange and bear the cost of the return of the Gift and we accept no responsibility for organising this with yourself or the Guest.

Privacy policy

It is very important that we have up-to-date contact details for you so please inform your Concierge of any changes to the information that you provided when registering.

We will only collect information about you, if it is willingly provided. In order to do any of the following, you will need to provide us with certain details:

  1. Create a Wedding List;
  2. Sign up for emails;
  3. Take part in a survey (in this instance, your details will be passed to a third party for research purposes); or
  4. Provide feedback to us.

The details you provide may include: your name(s), email address, Gift selections, delivery address, telephone/mobile numbers, a credit or debit card number, the card's expiry date and billing address. We will keep your personal information for as long as necessary and consistent with the purpose for which it was given to us.

Please refer to our Privacy Policy and Cookie Policy for further details on use of personal information.

We reserve the right to refuse access to our website, terminate Wedding Lists, remove or edit content, or cancel orders at our discretion. If we cancel a Wedding List, you will not be charged.

Events beyond our reasonable control

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.

Amendments to these Terms and Conditions

We may update these terms and conditions from time-time by posting a new version on our website. Any questions regarding these terms and conditions should be directed to the Wedding List, House of Fraser (Stores) Ltd, Store Support Centre, 27 Baker Street, London W1U 8AH.

Waiver

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.

Introduction

At House of Fraser, we know how important your relation’s or your friend’s wedding day is and we want both you and them to be delighted with our Wedding List Service (’Service’). These terms and conditions make it clear how the service works.

Once the couple have created their perfect Wedding List, it is made available to you and fellow Guests to order Gifts online, by phone or in store, which are then delivered by us to the couple on the date of their choosing.

The couple can check the progress of their Wedding List online and, if required, amend it whilst it remains open.

Guest Offer

For every £75 you spend on Gifts, including a pledge to a House of Fraser Gift Card, you will receive a House of Fraser voucher entitling you to £15 off purchases worth £75 or more. This voucher will be emailed, or, where you do not have an email address, posted to you after you have ordered your Gift from the Wedding List. Terms and conditions apply (see voucher for further details).

The wedding list

You can purchase Gifts from the wedding list 6 weeks prior to the couple’s wedding and up to 2 days thereafter. After this time the Wedding List will be closed and no further purchases can be made.

Gifts

You can order a Gift to be delivered to the couple:

  1. from the Wedding List Website;
  2. by phone on 0344 800 0535; or
  3. your closest store via the Wedding List Website at one of our in-store terminals. If you wish to do this, please speak to a member of staff in store for assistance.

Gift messages

You may leave a personal message for your couple when purchasing a Gift from their Wedding List. We do not take any responsibility for the contents of messages communicated by you.

Gift Cards

Please note that House of Fraser Gift Cards have their own terms and conditions and cannot be used for the purchase of Gift Cards, financial services or large kitchen appliances and cannot be exchanged for cash or used as payment on Recognition Card accounts. Please see online for further details.

Age restricted Gifts

The Wedding List may contain products that are restricted in sale by law. The following applies if you are attempting to buy such products:

You undertake to comply with these laws when purchasing such goods and that both you (as purchaser) and the List Holders (as recipient) are of legal age.

Pricing policy

However, Gifts on a Wedding List are subject to price fluctuations in line with our in store prices on a day-to-day basis. As a result, prices may change during the purchasing period. You will be charged the price available on the Wedding List Website on the day the purchase is made. In the event that a couple decides to return a Gift purchased by you, the amount paid will be credited to their Account (please see Gift alterations below).

Payment methods

Guests purchasing Gifts may pay with all major credit/debit cards: Visa, MasterCard, American Express, Maestro as well as by House of Fraser MasterCard, House of Fraser Account Card and House of Fraser Gift Card. Unfortunately, we are unable to accept payment by way of House of Fraser Gift Voucher or eVoucher.

Delivery

To allow for the timely delivery of the purchased Gifts to the List Holders, we collate the Gifts in our central warehouse as and when they are purchased by you and fellow Guests.

Delivery is made directly to the List Holders at their chosen address on a pre-arranged date. For security reasons, this information will remain confidential. We regret that we cannot deliver to any other address than the one given by the List Holders at the time of their registration.

Couples will be advised of your Gift purchase along with your personal message. All Gifts are wrapped carefully for delivery but not gift wrapped.

Gift Alterations

We will endeavour to ensure that any Gift you purchase from the Wedding List is available for delivery to the List Holders. From time to time, it is possible that Gifts will become unavailable or the List Holders may change their minds before the Gifts have been delivered and, if that is the case, the amount paid by you will be added to the List Holder’s Account so that they can choose an alternative Gift or receive a House of Fraser Gift Card to the equivalent value.

You agree that where such substitutions are made in respect of the Gift you purchased that we will have discharged our liability to you by substituting the Gift originally selected by you. You acknowledge that the purpose of the Service is that we provide the List Holder with a gift of equivalent value to the amount paid by you for a Gift. We are under no obligation to inform you of this substitution if it occurs.

Order confirmation

When you place an order to purchase a Gift from the Wedding List, we will send you confirmation that we have received the details of your order. Your order represents an offer to us to purchase a Gift, which is accepted by us when we process your payment and send you an email confirming that we have done so. Once the Gifts have been delivered to the List Holders, the contract between you and us will be concluded. In the event that you do not have an email address and you have ordered by phone or in a store, we will post or give you confirmation for your records.

We reserve the right not to accept your order for any reason whatsoever including, but not limited to: payment problems, product availability and not meeting our eligibility criteria set out above.

Payment problems

If, for any reason, there is a problem with collecting payment from your credit /payment card after we have confirmed receipt of your order, we will not be obliged to fulfill your contract. Additionally, on some occasions, we may be unable to process your order. The reasons for this may be due to:

  1. Your payment being declined; or
  2. An unspecified technical error.

We also retain the service of various credit rating and fraud prevention companies, and we may share details of your order with them for the sole purpose of detecting and preventing fraudulent use of your payment cards.

Cancelling your contract

The contract between us and you will be concluded, when your Gift(s) has been delivered to the List Holders. You can cancel your contract at any time up until the Gifts are delivered to the List Holders. At this point, pursuant to the Consumer Contracts Regulations 2014, you can cancel your contract with us within fourteen days for a full refund.

If you wish to cancel your contract in this manner, please call the Wedding List on 0344 800 0535 or visit a wedding list department in one of our stores. Please also let the List Holders know of your cancellation if they have received your Gift(s) as they will need to return the Gift in order for you to obtain your refund. They must also take reasonable care of the Gift during their possession and during its return. Once we receive the Gift, we will refund you to your original method of payment less any sums due by the way of compensation, to either repair the goods or to cover any loss. It is your sole responsibility to arrange and bear the cost of the return of the Gift and we accept no responsibility for organising this with yourself or the List Holders or for their failure to take reasonable care of the Gift.

Refunds will be made to the original payment card, including House of Fraser Gift Cards, so please retain your Gift Card in the event that you require a refund.
